1. Agreement to Terms

By accessing, using, or receiving services from HERMOSA HERMONIA ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be legally bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these terms, you must not use our services.

BINDING LEGAL AGREEMENT: These Terms constitute a legally binding contract between you and HERMOSA HERMONIA. By proceeding with any service, consultation, or payment, you acknowledge that you have read, understood, and agree to be bound by all terms herein.

We reserve the right to modify these Terms at any time without prior notice. Changes become effective immediately upon posting on our website. Continued use of our services after modifications constitutes acceptance of the revised Terms.

2. Service Description & Limitations

2.1 Nature of Services

HERMOSA HERMONIA provides cosmetic and aesthetic treatments including but not limited to facial treatments, hair treatments, body treatments, laser procedures, injectable treatments, and related beauty services. Our services are purely cosmetic and aesthetic in nature and are NOT medical treatments.

2.2 No Medical Claims

We make no medical claims regarding our treatments. Our services are not intended to diagnose, treat, cure, or prevent any medical condition or disease. Clients requiring medical treatment should consult qualified medical practitioners.

2.3 Results Disclaimer

CRITICAL DISCLAIMER: Results from treatments vary significantly among individuals. We provide NO GUARANTEE, WARRANTY, OR ASSURANCE regarding specific outcomes, effectiveness, or results from any treatment. Factors affecting results include but are not limited to:
  • Individual skin type, condition, and genetic factors
  • Age, lifestyle, and health status
  • Compliance with pre and post-treatment care instructions
  • Number of treatments received and interval between treatments
  • External environmental factors

3. Client Responsibilities & Medical Disclosure

3.1 Mandatory Medical Disclosure

Clients MUST provide complete and accurate information regarding:

  • All medical conditions, past and present
  • All medications, supplements, and topical treatments currently used
  • Previous cosmetic treatments and adverse reactions
  • Allergies and sensitivities
  • Pregnancy, breastfeeding, or attempts to conceive
  • Recent sun exposure, tanning, or planned sun exposure
MATERIAL MISREPRESENTATION: False, incomplete, or omitted information regarding medical history, medications, or health status will void all warranties, protections, and remedies. Clients bear full responsibility for complications arising from undisclosed medical information.

3.2 Age Requirements

Minimum age for treatments is 18 years. Clients under 18 require parental/guardian consent and must be accompanied by a parent/guardian. Certain treatments are restricted to clients 21 years and older.

3.3 Pre-Treatment Requirements

  • Patch testing may be required 24-48 hours before treatment
  • Arrive with clean skin free of makeup, lotions, or products
  • Avoid alcohol, blood thinners, and anti-inflammatory medications as advised
  • Follow all pre-treatment instructions provided
  • Inform us immediately of any changes in health status

4. Risks, Side Effects & Liability

4.1 Acknowledgment of Risks

Client acknowledges and accepts that all cosmetic treatments carry inherent risks including but not limited to:

  • Pain, discomfort, swelling, redness, and bruising
  • Temporary or permanent skin discoloration
  • Allergic reactions and hypersensitivity
  • Infection and scarring
  • Burns from laser, RF, or chemical treatments
  • Nerve damage (rare but possible)
  • Asymmetry and irregular results
  • Need for additional corrective treatments
  • Psychological impact from unsatisfactory results
ASSUMPTION OF RISK: By proceeding with treatment, Client voluntarily assumes all risks associated with the procedure. Client understands that no treatment is 100% safe and that complications can occur despite proper care and technique.

4.2 Limitation of Liability

HERMOSA HERMONIA's total liability for any and all claims, damages, losses, or injuries arising from or related to our services is strictly limited to the amount paid for the specific treatment that caused the claim, not to exceed ₹50,000 per incident, regardless of the nature or severity of the claim.

EXCLUSION OF DAMAGES: Under no circumstances shall HERMOSA HERMONIA be liable for:
  • Medical expenses or costs of corrective treatments
  • Lost wages, income, or business opportunities
  • Pain and suffering or emotional distress
  • Punitive or consequential damages
  • Any damages exceeding the treatment cost

4.3 Third-Party Medical Treatment

If Client requires medical treatment for complications, HERMOSA HERMONIA is not responsible for medical expenses, choice of medical provider, or outcomes of medical treatment. Client is solely responsible for all medical costs and decisions.

5. Payment Terms & Refund Policy

5.1 Payment Requirements

  • Full payment required before treatment commencement
  • Package treatments require complete upfront payment
  • Prices subject to change without notice
  • Additional charges may apply for special requirements
  • All prices are inclusive of applicable taxes

5.2 No Refund Policy

ABSOLUTE NO REFUND POLICY: ALL SALES ARE FINAL. HERMOSA HERMONIA provides NO CASH REFUNDS under any circumstances whatsoever, including but not limited to:
  • Dissatisfaction with treatment results
  • Change of mind or circumstances
  • Medical contraindications discovered post-payment
  • Inability to complete treatment packages
  • Pregnancy or medical conditions preventing treatment
  • Relocation or travel restrictions
  • Financial hardship or inability to pay
  • Force majeure events or business closure
  • Equipment malfunction or service interruption

5.3 Credit Note Policy

In exceptional circumstances, at the sole and absolute discretion of HERMOSA HERMONIA management, credit notes may be issued subject to the following strict conditions:

  • Credit notes are issued solely at management discretion
  • Maximum credit value limited to original treatment cost
  • Valid for 6 months from issue date only
  • Non-transferable and cannot be exchanged for cash
  • Cannot be used for discounted services or combined with offers
  • Expired credit notes become void with no extension possible
  • Management decision on credit notes is final and non-appealable
CREDIT NOTE DISCLAIMER: Issuance of credit notes does not constitute admission of fault, liability, or obligation. Credit notes are a goodwill gesture and do not create any legal rights or remedies for the Client.

6. Appointment & Cancellation Policy

6.1 Appointment Scheduling

  • Appointments are confirmed only upon full payment
  • Time slots are reserved exclusively for confirmed clients
  • Appointment times are approximate and may vary
  • We reserve the right to reschedule due to unforeseen circumstances

6.2 Client Cancellation & No-Show Policy

STRICT CANCELLATION PENALTIES:
  • No-Show: 100% forfeiture of all fees paid
  • Same-Day Cancellation: 75% forfeiture of fees
  • 24-Hour Notice: 50% forfeiture of fees
  • 48-Hour Notice: One-time rescheduling allowed
  • Late Arrival (>15 minutes): Treatment shortened or cancelled without refund

6.3 Package Treatment Forfeiture

Missed appointments in package deals result in forfeiture of that session from the package. No extensions, substitutions, or refunds will be provided for forfeited sessions.

7. Consent & Documentation

7.1 Informed Consent

Client must sign detailed informed consent forms for each treatment, acknowledging understanding of:

  • Treatment procedures and expected sensations
  • Potential risks and complications
  • Alternative treatment options
  • Post-treatment care requirements
  • Realistic outcome expectations

7.2 Photography & Documentation

We may photograph treatment areas for medical records and progress documentation. Separate consent is required for using images for marketing or educational purposes. Client has the right to decline photography.

7.3 Treatment Records

We maintain detailed treatment records for each client. Records may be shared with medical professionals in case of complications but are otherwise confidential per our Privacy Policy.

8. Dispute Resolution & Legal Jurisdiction

8.1 Dispute Resolution Process

All disputes must be addressed through the following mandatory process:

  • Step 1: Direct discussion with treating practitioner
  • Step 2: Written complaint to management within 30 days
  • Step 3: Internal review and written response within 10 business days
  • Step 4: Binding arbitration if dispute exceeds ₹1,00,000

8.2 Legal Jurisdiction

EXCLUSIVE JURISDICTION: All disputes, claims, and legal proceedings arising from or related to these Terms or our services shall be subject exclusively to the jurisdiction of courts in Mumbai, Maharashtra, India. Client consents to personal jurisdiction in Mumbai and waives any objections to venue or inconvenient forum.

8.3 Limitation Period

Any legal action or claim must be commenced within 1 (one) year from the date of treatment or the date when the claim reasonably should have been discovered, whichever is earlier. Claims filed after this period are permanently barred.

8.4 Class Action Waiver

Client waives the right to participate in class action lawsuits or class-wide arbitration against HERMOSA HERMONIA. All disputes must be resolved on an individual basis only.

9. Intellectual Property & Confidentiality

9.1 Proprietary Techniques

All treatment protocols, techniques, formulations, and methodologies used by HERMOSA HERMONIA are proprietary and confidential. Client agrees not to disclose, replicate, or use our techniques for commercial purposes.

9.2 Trade Secrets

Information regarding our equipment settings, product combinations, treatment sequences, and business methods constitute trade secrets and must not be disclosed to third parties.

9.3 Non-Compete

Clients who receive training or extended consultations agree not to establish competing beauty treatment businesses within 50 kilometers of our location for a period of 2 years.

10. Force Majeure & Business Continuity

10.1 Force Majeure Events

HERMOSA HERMONIA is not liable for delays, cancellations, or inability to provide services due to circumstances beyond our reasonable control, including:

  • Natural disasters, pandemics, or government restrictions
  • Equipment failure, power outages, or facility damage
  • Practitioner illness, injury, or unavailability
  • Supplier delays or product unavailability
  • Labor disputes or transportation interruptions

10.2 Business Closure

NO REFUND FOR CLOSURE: In the event of temporary or permanent business closure for any reason, HERMOSA HERMONIA's sole obligation is to provide reasonable notice when possible. NO REFUNDS will be provided for prepaid treatments or packages. Clients may be offered credit notes at management discretion.

11. Miscellaneous Provisions

11.1 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.2 Entire Agreement

These Terms, together with our Privacy Policy and treatment-specific consent forms, constitute the entire agreement between Client and HERMOSA HERMONIA, superseding all prior agreements or understandings.

11.3 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce such provision in the future.

11.4 Assignment

These Terms are personal to the Client and cannot be assigned or transferred. HERMOSA HERMONIA may assign these Terms to affiliated entities or successors.

11.5 Electronic Acceptance

Electronic acceptance of these Terms (including booking appointments online, making payments, or using services) constitutes a legally binding agreement equivalent to a written signature.
